    IMPORTANT: PLEASE CAREFULLY READ THESE TERMS OF SERVICE ("TERMS"). THEY CONTAIN LIMITATIONS OF LIABILITY, DISCLAIMERS, AND A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER.

    By accessing or using any websites, mobile apps, or other online services of City Gathers (together, the "Services"), you agree to be bound by these Terms. The Services are owned and operated by City Gathers ("we", "us", "our").

    1. Eligibility 
    You must be at least 13 years old to use the Services. If you are under 18, you must have your parent or guardian's permission. By using the Services, you represent that you meet these eligibility requirements.

    We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms in the Services. Your continued use after we provide notice constitutes acceptance of the updated Terms.

    THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND. CITY GATHERS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

    8. Limitation of Liability 
    NEITHER CITY GATHERS NOR ITS AFFILIATES SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICES. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

    9. Dispute Resolution 
    Any disputes relating to these Terms or the Services will be resolved through binding arbitration on an individual basis, rather than courts, except for intellectual property claims. Arbitration will be administered by JAMS under its streamlined rules. Both parties agree to bring claims on an individual basis only, and waive class action claims.

    10. Menu and Pricing Information 
    City Gathers strives to provide accurate and up-to-date menu and pricing information on our website or app. However, menus, items, and prices are subject to change without prior notice.
    While we make every effort to update the menus and prices listed on our digital platforms in a timely manner, there may occasionally be discrepancies between the information online and at our physical locations. In the event of a discrepancy, the prices and items available at the restaurant will govern.

    If an item you ordered through our website or app is unavailable, we will make every effort to contact you and provide alternative options. However, City Gathers reserves the right to make item substitutions or omissions if necessary.

    Please understand that City Gathers cannot honor incorrect menu or pricing information listed on our digital platforms if there is a conflict with in-store pricing. We apologize for any inconvenience this may cause and commit to keeping our online menus and prices as current as possible.

    11. Deals and Promotions 
    From time to time, City Gathers may offer promotional deals through our website, app, or other channels. The following terms apply to such deals unless otherwise specified:
        - Deals are only valid at participating City Gathers locations for a limited time, while supplies last.
        - Deals may only be available during certain hours or days as specified in the offer.
        - Each deal can only be redeemed once unless explicitly stated otherwise. Deals expire upon redemption.
        - There is a limit of one deal per customer per visit.
        - Deals have no cash value, are not transferable, and cannot be combined with other offers or discounts.

    Additional restrictions may apply to particular deals as outlined in the promotional details.
    City Gathers reserves the right to modify or cancel deals at any time. We recommend reviewing the specific terms of each promotion before attempting to redeem it.

    12. Miscellaneous
    These Terms are governed by the laws of California. Any provisions found unenforceable will be severed, and the remainder of the Terms will stay in effect. Failure to enforce any right does not constitute a waiver. You may not assign your rights under the Terms. We may assign our rights to an affiliate or successor.
